This Privacy Policy explains how The Negotiation Experts ("we", "us", "the firm") collects, uses, discloses, and safeguards information when you use thenegotiationexperts.com or engage with us. This policy is written in plain English. If something here conflicts with the signed engagement letter for a specific advisory mandate, the engagement letter governs for that mandate.

In short: we collect the minimum we need to respond to you, we don't sell or share your data for advertising, and we use the big-name analytics and form tools (Google Analytics via Google Tag Manager; Formspree) with consent.

1. Who we are

The Negotiation Experts is an independent enterprise IT contract negotiation advisory firm. The data controller for this website is the legal entity operating under the trading name "The Negotiation Experts". For data protection enquiries, email privacy@thenegotiationexperts.com.

2. Information we collect

a. Information you provide

Contact form submissions (processed via Formspree): name, work email, company, role, message.
White paper downloads: name, work email, company, role.
Newsletter signups: email address, optional name.
Engagement enquiries via email or phone: whatever you choose to share.

b. Information collected automatically

Server logs: IP address, user agent, timestamp, referring URL. Retained 90 days.
Google Analytics (GA4, loaded via Google Tag Manager): anonymised page views, event timings, device class. Fires only after cookie consent is granted. IP addresses are truncated.
Necessary cookies: session cookies for Formspree form submission; preference cookie recording your consent choice.

3. Why we collect it (lawful basis)

To respond to enquiries and deliver advisory services — lawful basis: contract, or legitimate interests.
To send our newsletter — lawful basis: consent.
To improve the website and security posture — lawful basis: legitimate interests.
To comply with legal obligations (e.g. tax records, anti-money-laundering for client engagements).

4. Who we share it with

We share personal data only with service providers strictly necessary to operate the site and deliver our services:

Formspree (contact form processing) — EU/US-based; Formspree privacy policy.
Google (Tag Manager, Analytics) — fires only after consent; Google privacy policy.
Email / hosting provider — for inbox delivery and website hosting.
Professional advisors (legal, accounting) — only when required.

We do not sell personal data, never have, never will. We do not share data with advertising networks. We do not participate in data broker exchanges.

5. International transfers

Some service providers are based in the United States. Where personal data of EU/UK residents is transferred outside the EEA/UK, the transfer is covered by Standard Contractual Clauses (SCCs) or an equivalent safeguard.

6. Retention

Contact form submissions: 24 months, unless the enquiry becomes a client engagement (then subject to engagement records retention below).
Client engagement records: 7 years after engagement close, for tax and professional-indemnity reasons.
Newsletter subscriber list: until you unsubscribe.
Server logs: 90 days.
Analytics data: 14 months (GA4 default).

7. Your rights (GDPR / UK GDPR / CCPA)

You have the right to access, correct, delete, restrict, and object to processing of your personal data. EU/UK residents additionally have the right to data portability and to lodge a complaint with a supervisory authority. California residents have additional rights under CCPA/CPRA including the right to know and the right to delete.

8. Cookies and tracking

This site uses a minimal cookie set. Analytics and tag manager cookies fire only after you grant consent via the cookie banner. You can withdraw consent at any time by clearing your browser cookies and refusing consent on next visit, or by emailing us. We do not use advertising cookies, remarketing pixels, or third-party social tracking.
